JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 04-07-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Chandi P.S. Case No. 115 of 2018 registered for the offence under Sections 304(B), 201 and 34 of the Indian Penal Code. The accused/petitioner is named in the F.I.R. and is in custody since 17.09.2021.

The allegation against the petitioner is to cause death of daughter of the informant due to non-fulfillment of demand of dowry.

Learned counsel appearing on behalf of the petitioner submitted that petitioner is father-in-law of the deceased, aged

It has further been submitted that nature of allegation as regard to demand of dowry is specific against the husband of the deceased and petitioner has been implicated in the present case only being father-in-law. It has further been submitted that the petitioner is a man of clean antecedent. While concluding the argument, it has been submitted that investigation has been completed, for which, charge-sheet has already been submitted in this case. Learned APP, while opposing the prayer of bail, fairly conceded the fact that petitioner is father-in-law.

Considering the facts and circumstances as mentioned above, as the petitioner is father-in-law having no connection with domestic affairs of the deceased coupled with the fact that allegation of demand of dowry is specific against the husband of the deceased, let the petitioner, above named, is directed to be released on bail in connection with Chandi P.S. Case No. 115 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.

"(i) Accused/Petitioner shall cooperate in the trial and shall be physically

(ii) That one of the bailors shall be Arjun Ram, who is the son of the petitioner and deponent of the present bail petition."
