Petitioner seeks bail on the ground that younger brother of the deceased did not name him in Amarpur P.S. Case no. 216/2015 which was lodged for the same occurrence and moreover, brother of the deceased, namely, Suman Kumar Singh was witness of the institution of Amarpur P.S. Case no. 215/2015 but when he lodged Amarpur P.S. Case no. 216/2015, he did not even whisper against the petitioner but I am not at all convinced with the aforesaid submission and it would appear from perusal of the report of Addl. Sessions Judge I, Banka that trial of the petitioner has already commenced and up till now, near about seven prosecution witnesses have already been examined.

Therefore, in the aforesaid facts and circumstances, prayer for bail of the petitioner in connection with Session trial no. 66/2016, 222/2016, 23/2016 arising out of Amarpur P.S. Case no. 215/2015

Patna High Court Cr.Misc. No.19975 of 2017 (3) dt.02-08-2017 pending in the court of Addl. Sessions Judge I, Banka is, again, rejected.
