The petitioner seeks regular bail in connection with Bibhutipur P.S. Case No. 244 of 2018, registered for the offence punishable under Sections 212, 406, 420 and 506 of the Indian Penal Code.
The allegation is regarding the petitioner having taken away the motorcycle of the informant, however, on the next day, when he had met the informant at Bambaiya Chowk, the co-villagers had caught the petitioner red-handed. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the motorcycle has not been
Patna High Court Cr.Misc. No.8988 of 2019(2) dt.18-02-2019 2/2 recovered from the conscious possession of the petitioner. It is further submitted that though the petitioner is accused in three other cases, but the same are very old cases and the petitioner is on bail in all the said cases. The petitioner is stated to be languishing in custody since 27.08.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 244 of 2018.
