JUSTICE MUNGESHWAR SAHOO ORAL ORDER 13-07-2016 Heard learned counsel, Mr. Manager Sah, for the petitioner and learned counsel for the respondents. In this application under Article 227 of the Constitution of India prayer has been made for directing the court below for dismissing Title Suit No.75 of 1998.

In my opinion, under Code of Civil Procedure there is no such provision or in exercise of supervisory jurisdiction, the High Court can direct the court below to dismiss the Suit. Thus, the writ application is not maintainable and it is accordingly dismissed.
