JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-06-2020 Heard Mr. Umesh Chandra Verma, learned counsel appearing for the petitioner as well as Mr. Anil Kumar Singh No. 1, learned Additional Public Prosecutor for the State through video conferencing.
Petitioner seeks bail in connection with Muffasil P.S. Case No. 285 of 2016 registered for the offences punishable under Sections 387, 506 of the Indian Penal Code. Petitioner is named in the first information report with allegation that he as well as co-accused went to the shop of informant and demanded extortion money. Furthermore, it is said that prior to that informant had received several telephonic calls demanding extortion money.
No doubt, in course of investigation, informant and some others claimed that petitioner and co-accused had come to

No.7931 of 2020(3) dt.08-06-2020 2/2 the shop of informant and demanded extortion money but the mobile numbers given in the written report of the informant, admittedly, belong to some other persons. Petitioner does not have criminal antecedents which is evident from perusal of paragraph no. 3 and, moreover, the petitioner is in jail custody since 27.10.2019 and the investigation against him has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Motihari East Champaran/ concerned court in connection with Muffasil P.S.
