Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 467, 468 of the I.P.C. and 30 (a), 36, 41 (I) of the Bihar Prohibition and Excise Act.

Prosecution case is that 7366.320 was recovered from different vechicles.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the State submits that that petitioner is to have registered owner of the vehicle registration number BR-31GB-4528 and BR-31GB-1665 and the relevant

Patna High Court CR. MISC. No.9398 of 2023(2) dt.25-04-2023 2/2 paper stands in the name of the petitioner.

Considering the facts of the case as also the fact that huge quantity of liquor has been recovered from the vehicle of which petitioner is registered owner, prayer for anticipatory bail is rejected.
