2. The petitioner has preferred this application for grant of regular bail in connection with KaluahiP.S. Case No. 96/2024 G.R. No. 1160 of 2024 dated 02.06.2024 registered for the offence punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, some unknown miscreants are alleged to have snatched Rs. 1,21,000/- from the possession of the informant when he was returning from the Bank along with one Ashu Gupta. The miscreants also assaulted Ashu Gupta with butt of pistol.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

The other co-accused person has already been granted bail by the co-ordinate Bench of this court vide order dated 22.08.2024 passed in Cr. Misc. No. 58665/2024. The petitioner is not named F.I.R. The name of the petitioner has sprung up in the confessional statement of the coaccused, Raja Babu Bhagat. The petitioner has four antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 21.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per para. 80 of the case diary, the stolen mobile phone was recovered from the house of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Kaluahi P.S. Case No. 96/2024 G.R. No. 1160 of 2024, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.8399 of 2025(2) dt.15-04-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
