JUSTICE SANJAY PRIYA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Riga P.S. Case No. 91 of 2016 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the First Information Report. There is no eye witness of the case.

It is alleged in the Fard-beyan that the grand-daughter of the informant went to play outside her house but she did not return. Thereafter, the informant started searching her and during search he learnt that dead body of his grand-daughter was lying under the bridge upon which the informant went there and found the dead body of his grand-daughter.

Patna High Court Cr.Misc. No.19071 of 2017 (3) dt.29-06-2017 2/2 Case diary has been received.

The witnesses in paragraphs-15, 16, 17, 18 and 19 of the case diary have raised mere suspicion against this petitioner. In such circumstances, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 91 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
