JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-05-2017 Heard learned counsel for the petitioner and the State.
The petitioner is accused in connection with Bochaha P.S. Case No. 163 of 2016 for the offence under Section 414/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
From the perusal of the F.I.R. it appears that country made loaded pistol and stolen motorcycle were recovered from the possession of the petitioner. The petitioner is in jail since 26.10.2016 and similarly situated co-accused Sunil Kumar was granted bail by this Hon'ble Court on 15.05.2017 passed in Criminal Miscellaneous No. 8568 of 2017. The petitioner stated in para-3 of the petition that he has no criminal antecedent.
Patna High Court Cr.Misc. No.20239 of 2017 (3) dt.30-05-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur or his successor Court in connection with Bochaha P.S. Case No. 163 of 2016 on the condition that the petitioner shall co-operate in the trial and will not in any manner influence the evidence or the witnesses.
