The petitioner seeks bail in Kharagpur P.S. Case No. 210 of 2016 registered under Sections 25(1-b)a and 26 of the Arms Act.
The informant disclosed that the petitioner was apprehended in connection with Sangrampur P.S. Case No. 115 of 2016 and Bariyarpur P.S. Case No. 106 of 2016. The petitioner is said to have confessed his guilt and disclosed that the mobile from which the extortion was demanded was kept in his house and on such disclosure, Dinesh Kumar, the informant of the case, raided the house of the petitioner, but no mobile was recovered. Leanred counsel for the petitioner submits that the petitioner was in custody, but to make the case serious, the
Patna High Court Cr.Misc. No.19706 of 2017 (3) dt.19-05-2017 2/2 investigating officer showed the recovery of one arm and ammunitions from the house of the petitioner. One country made pistol and five live cartridges are said to have been recovered. It is submitted that admittedly on the date of recovery, the petitioner was in custody from before.
Considering the facts aforesaid that the petitioner was in custody and on his disclosure, house of the petitioner was raided and no mobile was recovered and the police showed the recovery of one loaded country made pistol and five live cartridges from the house of the petitioner, for that the petitioner is in jail for 51⁄2 months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Munger in connection with Kharagpur P.S. Case No. 210 of 2016.
