The petitioner seeks bail in Pauthu P.S. Case No. 20 of 2017 registered under Sections 379, 411 and 34 of the Indian Penal Code.
The informant lodged the case against the unknown for theft of his tractor bearing registration no. BR 26HO 778. The informant later on got information that his tractor was kept in the village Ittar. While the informant along with the police officials were on the way to the village Ittar, he saw his tractor is being driven by one Amar Kumar and the police apprehended Amar Kumar. Amar Kumar disclosed the name of the petitioner that he was also with him in the theft of tractor.
Leanred counsel for the petitioner submits that
Patna High Court Cr.Misc. No.19669 of 2017 (2) dt.01-05-2017 2/2 except confessional statement of Amar Kumar, there is no other tangible material against the petitioner to show his involvement in the theft. The petitioner is in jail since 17.02.2017. Considering the facts aforesaid and that the name of the petitioner figured in the confessional statement of Amar Kumar and the petitioner has got no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Aurangabad in connection with Pauthu P.S. Case No. 20 of 2017.
