JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This application, for grant of anticipatory bail, arises out of Hussainganj P.S. Case No. 290 of 2018, disclosing offences under Sections 302/201 and 34 of the Indian Penal Code.
Allegation as per F.I.R is that a dead body was recovered and same was identified as the dead body of Neha Kumari and petitioner, who happens to be brother of husband of the deceased is not named in the F.I.R., his name transpired during course of investigation.
Submission of learned counsel for the petitioner is that he is not named in the F.I.R. and has falsely been implicated in this case and in the entire case diary save and except suspicion, there is nothing against the petitioner and petitioner happens to brother of husband of deceased Neha Kumari and
Patna High Court CR. MISC. No.9850 of 2019(3) dt.25-04-2019 2/2 para -34 of the case diary disclosed that petitioner has been living separately and further the cause of death has also not been ascertained.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No. 290 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
