JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2017 From perusal of the record it appears that petitioner No.1 Manish Thakur has already been granted bail by this Court vide order dated 12.5.2017 and with respect to petitioner No.2 Manoj Thakur, the Superintendent of Police, Sheohar was directed to obtain injury report along with opinion on injury of the injured from S.K.M.C.H. and submit the same to this Court. Heard learned counsel for the petitioner.
This is an application for bail in connection with Piprahi P.S.Case No. 27 of 2017 registered for the offences punishable under Sections 341, 342, 323, 324, 325, 307, 354, 458, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant and her family members.
Patna High Court Cr.Misc. No.17658 of 2017 (4) dt.19-06-2017 2/3 It has been submitted on behalf of the petitioner that there is land dispute between the parties from before and there is no intention of causing death to any person.
Heard learned APP and learned counsel for the informant also. They have opposed the prayer for bail of the petitioner stating that petitioner has caused injury on the person of the informant and her family members.
From perusal of the injury report it appears that the injuries are simple in nature and petitioner has remained in custody for three months, let the petitioner, namely, Manoj Thakur, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Vishal Kumar, Judicial Magistrate, 1st Class, Sheohar, in connection with Piprahi P.S.Case No. 27 of 2017, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required
Patna High Court Cr.Misc. No.17658 of 2017 (4) dt.19-06-2017 3/3 by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.
