JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 448 and 504 of the Indian Penal Code. The prosecution case is that co-accused Ram Gulam Paswan assaulted with cutter causing injury on the head of the informant when petitioner no.1 assaulted with Khanti causing injury on the wrist of the left hand of the informant and when brothers of the informant, Sanjay Mahto and Dina Mahto came to rescue, petitioner no.1 and petitioner no.3 assaulted them with danda. It is further alleged that petitioner nos.4 and 5 assaulted the wife of Sanjay Mahto.

No.1429 of 2016 (3) dt.20-01-2016 2/2 It is submitted by learned counsel for the petitioners that only the informant and his brother Dina Mahto received simple injuries and neither Sanjay Mahto nor his wife received any injury. There is counter version of the occurrence also and petitioners' side also received injuries. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sheikhpura in connection with Barbigha P.S. Case No. 353 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
