JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, the informant came to know about the name of petitioner on the basis of conversations of the culprits.

Learned counsel for the petitioner submits that on the alleged date of occurrence one another case i.e Amarpur P.S.Case No. 198 of 2015 was instituted against the co-accused Chandan Kumar and Barun Kumar for the offence under the Arms Act and the aforesaid co-accused disclosed the name of the petitioner. It is further contended by him that nothing has been recovered from conscious possession of the petitioner.

No.53882 of 2015 (2) dt.30-11-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bhagalpur in connection with Sajour ( Shahkund) P.S.Case No. 111 of 2015.
