Petitioners seek regular bail in a case registered for the offence punishable under Section 467, 468 and some other ancillary Sections of the Indian Penal Code and under Section 30 (a), 36, 41(1) of the Bihar Prohibition & Excise Act. As per the prosecution case, these petitioners were apprehended from two tempos and from the vehicles 306 liters of foreign liquor has been recovered.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in

No incriminating article has been recovered from the conscious possession of the petitioners and they are no way concerned with the alleged recovery. Petitioners are neither driver nor owner of the vehicles in question and they are simply co-passengers. Petitioners claim clean antecedent and are in custody since 15.11.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Gaighat PS case No. 414/2021.
