The petitioners seek pre-arrest bail in connection with Adapur P.S. Case No.132 of 2015 registered under Sections 147, 148, 323, 324, 380, 427, 436 and 504 of the Indian Penal Code as well as Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It has been contended that the similarly circumstanced co-accused Shamsher Alam, Ashique Mian @ Ziaul Haque, Saheb Diwan, Naushad Alam and Tarana Ansari @ Tarana have already been granted anticipatory bail by a co-ordinate Bench of this Court
Patna High Court Cr.Misc. No.57686 of 2015 (2) dt.29-01-2016 2/2 vide order dated 16.10.2015 passed in Cr. Misc. No.48511 of 2015.
Learned Special Public Prosecutor appearing for the State does not dispute the aforesaid submission made by the learned counsel for the petitioners.
Regard being had to the reasons assigned in the aforesaid order dated 16.10.2015 as contained in Annexure-4 to the present application, in the event of arrest/surrender in the court below within six weeks from today, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihar in connection with Adapur P.S. Case No.132 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
