2. The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A and 34 of the Indian Penal Code and later on, Section 376 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act were added.
3. Lastly, the prayer for grant of bail to the petitioner was rejected by a Co-ordinate Bench of this Hon'ble Court vide order dated 20.07.2024 passed in Cr. Misc. No. 28619 of 2024.
4. In pursuance to direction of this Hon'ble Court dated 04.04.2025, a report with regard to present stage of trial has been received. Perusal of the trial court report dated
Patna High Court CR. MISC. No.11565 of 2025(3) dt.27-06-2025 2/2 22.04.2025 reveals that till date, total seven witnesses have been examined and process has been issued for examination of rest of the witnesses. Petitioner has got no criminal antecedents and he is in custody since 29.08.2022.
5. Considering the aforesaid facts and circumstances of the case, tardy progress of trial, clean antecedents of the petitioner and period of custody, the prayer for grant bail of to the petitioner is allowed.
6. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cumSpecial Judge, POCSO, East Champaran at Motihari in connection with Rajepur P.S.
