JUSTICE GOPAL PRASAD ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned counsel for the State. The petitioner has been arrested in connection with Gamharia P.S. Case No. 60 of 2014, registered under Sections 306/34 of the Indian Penal Code.
Learned counsel for the informant submits that victim has committed suicide due to the reason that one day prior to the occurrence, the petitioner tried to outrage modesty of the victim by entering into her room, but the brother of the victim chased for which a case was registered bearing Gamharia P.S. Case No. 56 of 2014.
However suspicion has been raised that victim may have commit suicide for the said occurrence for which Gamharia P.S. Case No. 56 of 2014 has been filed. However, except suspicion, there is nothing against the petitioner. It is further submitted that petitioner is in jail custody since 26.09.2014. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on
Patna High Court Cr.Misc. No.47413 of 2014 (3) dt.10-04-2015 furnishing bail bonds of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Avinash Kumar, learned Judicial Magistrate, 1st Class, Madhepura, in connection with Gamharia P.S. Case No. 60 of 2014. m.p.
