The Petitioner seeks bail in Muffasil P.S. Case No. 430 of 2016 instituted for the offence under Section(s) 392 and 411 of the Indian Penal Code.
The informant has alleged that on the date of occurrence at the point of pistol, two persons snatched his bag containing Rs. 37, 265/-, ATM Card of Axis Bank, Cheque Book, I. D. Card, paper of motorcycle, driving licence and other papers and took away the key of his motorcycle.
It has been submitted on behalf of the petitioner that his name surfaced in paragraph nos. 5 and 6 of the case diary when police after arresting him recorded his confessional
Patna High Court Cr.Misc. No.4512 of 2017 (2) dt.14-02-2017 statement. Learned sessions judge has mentioned that some looted documents were recovered from the possession of the petitioner. The seizure list have been enclosed with the written report which shows that the some documents have been recovered but they do not tally with the description of the documents given in the FIR. The petitioner is said to be in custody since 26.10.2016. In the facts and circumstances of the case, let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Mufassil P.S. Case No. 430 of 2016 subject to the conditions that both the bailors shall be the close relative of the petitioner.
