The petitioners apprehend their arrest in Warisaliganj P.S. Case No. 224 of 2021, registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and sections 66(B)/66(D) of the Information Technology Act, 2020.

As per the prosecution case, all the FIR named accused persons induced the public and cheated them by

Patna High Court CR. MISC. No.9761 of 2022(2) dt.04-08-2022 2/2 offering high interest rate on their deposit. During course of search, from the house of co-accused Kundan Kumar mobiles, pass-book of Gramin Bank, customer detail sheet were recovered.

It is submitted that petitioners are not named in the FIR. Name of petitioners transpired during course of investigation on the basis of confessional statement of coaccused. No incriminating article has been recovered from possession or from the premises of the petitioners. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 2nd, Nawada in connection with Warisaliganj P.S. Case No. 224 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
