Petitioner is not named in the first information report and admittedly, after investigation, police submitted final form showing "no clue" and when petitioner was arrested in connection with Babubarhi P.S. Case no. 109/2006, one of stolen idols was recovered from his house. The learned trial court has reported that trial of the petitioner has already commenced and up till now, two prosecution witnesses have already been examined.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Ladaniya P.S.
