JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has been recovered at Kerala from house of the petitioner and, thereafter, her statement u/S 164 of the Cr.P.C. was recorded, in which, she specifically, stated that it was coaccused, Jay Prakash and Gulabi Devi who took her to Kerala and handed over to the petitioner. The victim was found 16-17 years by Medical Board whereas; the victim disclosed her age as 21 years and the learned Magistrate, who recorded the statement of victim, assessed her age as 20 years.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.53784 of 2015 (2) dt.30-11-2015 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Harsidhi P.S. Case No. 347 of 2014 corresponding to Sessions Trial No. 461 of 2015 to the satisfaction of learned Additional District & Sessions Judge-Ist, East Champaran, Motihari.
