No doubt, petitioner is named in the first information report and he carries criminal antecedent but according to the prosecution case itself, one culprit was caught on the spot and said culprit disclosed that he as well as his associate, namely, Satrudhan Chaudhary committed alleged occurrence.

So far as petitioner is concerned, it is only stated that he also crossed place of occurrence much prior to alleged occurrence. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Jamhore P.S. Case no. 99/2013.
