JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Deoria P.S. Case No. 145 of 2019, registered for offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 17 of the C.L.A. Act.

Allegation against is of recovery of one rifle and one country made pistol as well as 12 cartridges from the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on the basis of confession of co-accused and in fact there is no recovery in this case. Further, he has no criminal antecedent and has been in judicial custody since 17.10.2019.

Heard learned A.P.P. also.

No.8484 of 2020(2) dt.27-02-2020 2/2 Having heard both sides, in view of the recovery of rifle, country made pistol and cartridges, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail.
