JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

Stolen bottles of chilly sauce are said to have been recovered from thela and rented house of the petitioner but according to prosecution case itself, petitioner used to purchase the aforesaid bottles from wholesale shop of the informant. Moreover, petitioner is in jail custody since 25.10.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.980 of 2017 (2) dt.16-01-2017 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 225 of 2016.
