The petitioner is in jail custody since 31-10-2014 in a case initially, registered under Sections-302, 201/34 of the Indian Penal Code but after investigation, police submitted charge sheet u/Ss 306, 201/34 of the Indian Penal Code though the court below took cognizance under Sections-302, 201/34 of the Indian Penal Code.

The petitioner happens to be husband of the deceased and it appears that the marriage of the petitioner had taken place with the deceased in the year 1996 and, thereafter, the petitioner solemnized his second marriage in the year 2008 with another woman.

Although there is allegation of torturing against the
