1. Heard learned counsel appearing on behalf of the parties.

Learned counsel appearing on behalf of the appellant seeks permission to withdraw the present appeal, which is against acquittal, as to file the same before Division Bench of this Court, for the reasons that one of the offence in which respondent no. 2 was acquitted for offence under Section 307 of the Indian Penal Code, where sentence may go up to life imprisonment.
