JUSTICE PARTHA SARTHY ORAL ORDER 26-06-2020 Heard learned counsel for the petitioners and learned counsel for the State through video conferencing. The petitioners have filed the instant application for grant of anticipatory bail apprehending their arrest in connection with Bounsi P.S. Case no. 205 of 2017 registered under sections 467, 468, 420, 471 and 120B of the Indian Penal Code.
As per allegation in the FIR, it is stated by the informant that with respect to the land which fell in his share in the family partition the accused persons have tampered with the record in the Jamabandi and have raised a dispute. It is stated that on enquiry it transpired that the two petitioners were amongst the four persons who were behind this.
It is submitted by learned counsel for the petitioners that
Patna High Court CR. MISC. No.11897 of 2020(2) dt.26-06-2020 2/2 so far as the petitioners are concerned they are innocent and have been falsely implicated in the case. The first information report has been filed on suspicion and there is also a litigation going on between the informant and the petitioner no. 1. It is further submitted that Jamabandi Case no. 102/18-19 has also been filed by the informant which is going on. The application for bail is opposed by learned counsel for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation as made in the FIR, the Court is inclined to enlarge the petitioners on anticipatory bail. The petitioners are directed to surrender in the Court below within a period of eight weeks from today and in the event of their arrest or surrender in connection with Bounsi P.S. Case no. 205 of 2017 they will be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka subject to the condition as laid down under section 438(2) of the Cr.P.C.
