Learned counsel for the petitioner submits that during pendency of the bail petition, the petitioner has been granted bail under Section 167(2) of Cr.P.C. by the learned court below itself, and as such, the present bail application has become infructuous. Accordingly, the learned counsel for the petitioner seeks permission to withdraw this application in connection with Siwan Muffasil P.S.Case No.352 of 2020 pending in the court of learned A.D.J. Special Excise Court-II, Siwan. Permission is accorded.
