JUSTICE SANJAY KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner seeks regular bail in connection with Chapra Muffasil P.S. Case No. 422 of 2016 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30, 38, 41 of the Bihar Prohibition & Excise Act, 2016.
The Police Officer on secret information conducted raid at the place from where they seized 15 liters of country made liquor. The persons, who were indulged in selling the country made liquor tried to flee away from the place of occurrence, but on chase, two of them including this petitioner were arrested.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.5569 of 2017 (2) dt.07-02-2017 2/2 seizure list was made in absence of this petitioner, it does not bear the signature of this petitioner and the said liquor was recovered from the open field. Learned counsel for the petitioner further submits that the petitioner is in custody since 27.12.2016, having no criminal antecedent.
Considering the period of custody of the petitioner as well as facts and circumstances stated above, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saran in connection with Chapra Muffasil P.S.
