JUSTICE SHIVAJI PANDEY ORAL ORDER 12-01-2021 Heard learned counsel for the petitioner and the State. In the present case, the petitioner is seeking bail in connection with Daudnagar P.S. Case No.302 of 2019 registered for offences punishable under Sections 395 & 397 of the Indian Penal Code.

Allegation has been made in the FIR that some unknown miscreants looted about Rs. 20 lacs from the informant and also injured the informant with gun shot injury. Counsel for the petitioner submits that the petitioner has not been named in the FIR and his name has come during investigation. He further submits that looted amount has not been recovered from the possession of the petitioner and the petitioner has not been put on TIP. It is urged that he is in custody since 9.12.2019 having no criminal antecedent.

No.7907 of 2020(8) dt.12-01-2021 2/2 Considering the entire facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 302 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.

That apart, he would be required to appear before the Officer-in-charge of the concerned police station within fifteen days of his release with a copy of this order and every month thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the police station concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail.
