The petitioner being the husband of the victim is languishing in custody since 19.03.2013 in a case registered for the offences punishable under Section 302 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after six years of the marriage as the petitioner used to assault the daughter of the informant. On the date of the occurrence when the victim went to her parent's place it was objected by this petitioner and the victim was assaulted brutally as a result of which she died.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.28521 of 2013 (07) dt.09-02-2015 2/2 petitioner that the case was registered under Section 302 of the IPC and there is no demand of dowry. The post-mortem report does not reflect any injury of assault as she committed suicide. The victim committed suicide has been supported by parental cousin of the victim and her husband, who are neighbours of the victim.
This fact has not been controverted by learned APP that there is no eye witness to the occurrence. The I.O. has not investigated this fact that the victim committed suicide by closing the door from inside as claimed by the petitioner.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Balrampur P.S. Case No. 19 of 2013. (Dinesh Kumar Singh, J) DKS/- U T
