2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act in connection with Ganga Bridge P.S. Case No.189 of 2025.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and allegation is of recovery of 50 liters of illegal country made liquor from a gunny bag. Further submits that no recovery has been made from the conscious physical possession of the petitioner and it has been recovered from a Palani.

4. The learned APP for the State opposes the anticipatory bail application.

Considering the fact that no recovery has been made from the conscious physical possession of the petitioner and also taking into account that it has been recovered from a Palani which the petitioner denies to be his, and also taking into account the fact that the petitioner has only one antecedent, this Court is inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.1cum-District & Additional Sessions Judge, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No.189 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C./Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
