JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. At the very outset, learned counsel for the petitioner submits that petitioner is still ready to lead his married life with the informant and the aforesaid stand was also taken before the court below but the informant in collusion with her parents lodged this false case against the petitioner.

Considering the facts and circumstances of the case as well as submissions of the parties, this regular bail petition filed in connection with Special Case No. 33 of 2014 arising out of Dhamdaha P.S. Case No. 230 of 2014 stands disposed of with direction to learned 1st Additional Sessions Judge-cum-Special Judge, Purnea to issue notice to informant as well as production

Patna High Court Cr.Misc. No.48806 of 2014 (3) dt.13-04-2015 warrant to petitioner fixing a date for conciliation and if petitioner undertakes before him to keep the informant properly as his legally wedded wife, the petitioner shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned court but if petitioner refuses to keep the informant as his legally wedded wife, the learned court below shall pass appropriate order and after that petitioner shall be at liberty to file a fresh bail petition before the learned court below itself and the said bail petition shall be disposed of by the learned court below on its own merit without being prejudiced by this order.
