Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504 of the Indian Penal Code and 3(1)(x) of the S.C./S.T.(Prevention of Atrocities) Act.

The prosecution case is that the informant went to Gaya Collectoriate to enquire about the selection made by the Bihar Staff Selection Commission being one of the appearing candidates. The informant gave his roll number, but the petitioner did not disclose the result and abused the informant by calling caste name.

It is submitted by the learned counsel for the petitioner that there is counter version of the occurrence being Civil Lines P.S. Case No. 213 of 2003, lodged by the petitioner

Patna High Court Cr.Misc. No.1451 of 2016 (2) dt.12-01-2016 for being assaulted by the informant. It is further submitted that investigation is still going on and petitioner is the employee of the Gaya Collectoriate.

Considering the nature of accusation and the case is pending between the parties, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with S.C/S.T. (Gaya) P.S. Case No. 30 of 2003, pending in the court of learned Chief Judicial Magistrate, Gaya.

With the above observation this application is disposed of.

It is expected from the learned court below to dispose of the regular bail application of the petitioner preferably on the same day.
