The petitioners have preferred this application for grant of regular bail in a case registered under sections 420, 406, 467, 468 and 34 of the Indian Penal Code.
As per the prosecution case, by way of a conspiracy the three accused persons who are the three petitioners herein and are in job of the informant's firm gave delivery of seven motorcycles thus causing loss of Rs. 4,29,593/- to the informant. It is submitted by learned counsel for the petitioners that the allegations as levelled in the FIR are false and
Patna High Court CR. MISC. No.20692 of 2021(2) dt.24-09-2021 2/2 concocted. The petitioners have been falsely implicated in the case. Learned counsel further refers to a compromise petition arrived at between the parties which has been brought on record as annexure to the supplementary affidavit, from the content of which it transpires that the three petitioners have deposited the sum of Rs.4,23,593/- in the informant's firm. The petitioners are in custody since 6.12.2020 and have no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, specially the contents of the compromise petition brought on record by way of supplementary affidavit, the petitioners are directed to be enlarged on bail in connection with Gopalganj P.S. Case no. 683 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
