The petitioner seeks bail in anticipation of his arrest in connection with Saraiya P.S. Case No. 692 of 2019, dated 13.10.2019, instituted for the offences under Sections 272, 273, and 120(B)/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. From the prosecution version, it appears that a secret information was received by the police that huge quantity of liquor is being stored in the house of one Rakesh Thakur. On such information, the police proceeded to raid the house of aforesaid Rakesh Thakur, but he managed to escape his effect. However, the other persons also, who were said to have fled away from the place of raid, were identified by the local Dafadar. In that connection, the name of the petitioner has been taken.

It has been submitted on behalf of the petitioner that he is not at all related in any manner to aforesaid Rakesh Thakur. The petitioner claims to be a person of clean antecedent. Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest/surrender before the

Court below within a period of eight weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Muzaffarpur in connection Saraiya P.S. Case No. 692 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
