This application for grant of anticipatory bail arises out of Maharajganj P.S. Case No. 82 of 2015, disclosing offences under Sections 304B and 201/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioner no. 1 is the father-in-law of the deceased whereas, petitioner no.2 is simply a villager of petitioner no. 1 and not at all connected with the family of the husband of the deceased. He has drawn my attention to an order dated 24.07.2014 passed in Criminal Miscellaneous No. 28448 of 2015 whereby, mother-inlaw and some other family members of the husband of the

Patna High Court Cr.Misc. No.58544 of 2015 (2) dt.22-01-2016 2/2 deceased have been granted anticipatorily bail. In view of the submission that similarly situated accused persons have been granted anticipatory bail, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 82 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
