JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Barahara (Krishna Garh) P.S. Case No. 353 of 2016, registered under Section 30 of the Bihar Excise Act, 2016. The accusation is that both petitioners were apprehended with motorcycle. On search, 39 bottles, each containing 750 ml of Indian made foreign liquor, were recovered from the gunny bag kept on the motorcycle.

Learned counsel for the petitioner submits that petitioners have no criminal antecedent and are in custody since 28.11.2016.

Patna High Court Cr.Misc. No.6085 of 2017 (2) dt.06-03-2017 Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur (Ara) in connection with Barahara (Krishna Garh) P.S. Case No. 353 of 2016. Out of two sureties, one surety must be the close relative of the petitioners.
