Petitioner is accused in connection with Suiya P.S. Case No. 57 of 2018 registered under Sections 302/34 of the Indian Penal Code pending in the Court of Additional Chief Judicial Magistrate-1, Banka.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case. She is in custody since 01.08.2019. Further submission is that she has been made accused in this case only on suspicion. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail and submits that during investigation, materials have come against this petitioner

Patna High Court CR. MISC. No.10631 of 2019(3) dt.11-04-2019 2/2 showing her involvement in the alleged crime as would be evident from perusal of paragraphs 33, 37, 38, 39, 40 and 45 of the case diary. He, therefore, submits that petitioner does not deserve to be granted the privilege of bail.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
