16-02-2016 Heard Sri Premchandra Yadav, learned counsel for the petitioner and Sri Abhay Kumar Roy, learned Addl. Public Prosecutor.

The petitioner, who is mother-in-law of deceased apprehending her arrest in Ben P.S. Case no. 55 of 2015 registered for the offence under Sections 304(B)/34 of the Indian Penal Code and subsequently, 306 of the I.P.C. was added, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that the allegation of offence under Section 304(B) of the I.P.C. has been levelled, however; during investigation, it was found that it was a case of suicide. It has also been submitted that some of the accused persons have been granted bail. He further submits that the chargesheet has been submitted against the husband of the

Patna High Court Cr.Misc. No.1433 of 2016 (3) dt.16-02-2016 2/2 deceased, who is still lying in the custody.

Earlier, the case diary was called for.

After hearing learned counsel for the parties, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.

Accordingly, let the petitioner namely Manju Devi be enlarged on bail in the event of her arrest or surrender within a period of six weeks from today on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Ben P.S. Case No. 55 of 2015 subject to condition as laid down under Section 438 (2) of the Cr.P.C.
