JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 461, 379, 411 and 120(B) of the Indian Penal Code.
It is alleged that one Tempo was intercepted and police recovered the black stone idol of 'Shiv-Parvati' from the lap of co-accused Basant Kumar Sah. It has further been alleged that the petitioner was found sitting in the Tempo.
The learned counsel for the petitioner has submitted that the petitioner has clean antecedent. He was merely the passenger of the aforesaid Tempo and nothing was recovered from his possession. He is in custody since 5.9.2016. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.4987 of 2017 (2) dt.22-02-2017 2/2 the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Madhubani, in connection with Babubarhi P.S. Case No. 144 of 2016 (G.R. No. 1819 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
