Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The FIR was lodged against unknown on recovery of dead body of a female and her child from a well. The female was second wife of the son of this petitioner. Submission is that there is no direct evidence to have anyone seen the petitioner along with deceased before her death. Co-accused Chhatradhari Yadav @ Chhetradhari Yadav has been allowed anticipatory bail by a Co-Ordinate Bench of this Court vide Annexure 2.

Considering the aforesaid facts as well as completion of investigation against the petitioner, let the petitioner, above

Patna High Court CR. MISC. No.9841 of 2019(3) dt.02-05-2019 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Fatehpur Police Station Case No. 214 of 2018, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
