2. The petitioner is seeking regular bail in connection with Rajpur P.S. Case No. 264 of 2024 for the offences punishable under Sections 140(3) of the BNS, 2023.
3. As per allegation, Ankit Kumar Maurya (the deceased) went out of his house after informing his father that he would return soon, but he did not return. His brother, Aditya Kumar, informed the informant that he had seen the petitioner riding a motorcycle along with the deceased. The informant tried to contact his son on his mobile number 6375381039, but it was switched off. The mobile phone of the present petitioner, bearing number 7056107342, was also found switched off.
4. Learned Counsel for the petitioner has submitted
Patna High Court CR. MISC. No.13757 of 2025(3) dt.09-05-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. He is a relative of the deceased, and no motive has been assigned for the commission of this occurrence. He has further submitted that the statement of Aditya Kumar has not been recorded by the investigating authorities. None has seen the occurrence.

During the course of investigation, the CDR of the mobile number of the present petitioner was detected, and it was found that he was on telephonic conversation with the deceased several times throughout the day of the occurrence. It was also found that the petitioner had telephonic conversation on mobile number 9263985505, and the holder of that mobile was Pooja Kumari. In her statement recorded in Paragraph No. 39 of the case diary, Pooja Kumari stated that she had love and affection with the petitioner. After some time, she developed love and affection with the deceased also. In the post-mortem report, it was found that the death of the deceased was caused due to a neck cut injury. A sharp cut injury on anterior region of neck size 5" X 1⁄2" X 1" was found on his neck.
6. The petitioner was last seen with the deceased. He had frequent conversations on the date of occurrence with the deceased. The dead body of the deceased was found soon
Patna High Court CR. MISC. No.13757 of 2025(3) dt.09-05-2025 3/3 thereafter having noted injuries on the neck.
6. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
