JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to prosecution case itself, the alleged occurrence took place on 01.05.2015 whereas the first information report was lodged on 16.06.2015 and no explanation regarding the aforesaid delay was given. Moreover, the informant came to know about the involvement of the petitioner in the present crime from his brother in law, namely, Birendra Singh who disclosed before him that abducted boy had been kept in the house of the petitioner. It would appear from perusal of the impugned order that victim has not been recovered as yet but except the statement

Patna High Court Cr.Misc. No.53975 of 2015 (2) dt.02-12-2015 2/2 of aforesaid co-accused, Birendra Singh, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dehri-on-Sone, Rohtas in connection with Dehri Nagar (Town) P.S.
