The petitioners seek bail in connection with Goreakothi P.S. Case No. 87 of 2019, registered under Sections 363 and 366A/34 of the Indian Penal Code.

The accusation is that daughter of the informant, aged about 16 years, has gone in the village to attend the function of the marriage, but, she did not return. In course of search, informant came to know from villagers that her daughter was seen with Sona Kumar (petitioner no. 1). The informant raised suspicion about kidnapping of her daughter by Sona Kumar and his family members for the purpose of marriage. Submission is that in fact, due to love affairs the

No.9974 of 2020(2) dt.27-02-2020 2/2 daughter of the informant moved with the petitioner no. 1, but, later on, on pressure of the family members she gave statement under Section 164 of the Criminal Procedure Code making allegation of her kidnapping by the petitioners. Later on, Jyoti Kumari, the victim-girl, filed an application in the Court of the Chief Judicial Magistrate, Siwan, to the effect that due to love affairs she had left the house with petitioner no. 1 and has performed married with him, which would appear from Annexure 3.

Having regard to the facts and circumstances of the case, let the petitioners, above named be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each swith two sureties of the like amount each in connection with Goreakothi P.S. Case No. 87 of 2019 to the satisfaction of the Chief Judicial Magistrate, Siwan.
