JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)A, 26 of the Arms Act. Admittedly, nothing was recovered from conscious possession of the petitioner and the certified copy of seizure list goes to show that copy of aforesaid seizure list was not served upon the family members of the petitioner which appears to be violation of Section 100(6) of the Cr.P.C. Moreover, petitioner is in jail custody since 13.11.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.998 of 2017 (2) dt.16-01-2017 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 260 of 2016.
