In this case, the petitioner is seeking regular bail in connection with Hajipur Town P.S. Case No. 693 of 2019 registered for offence punishable under section 395 of the Indian Penal Code.

As per allegation, the accused persons entered into the office covering their faces and looted Rs.15,000,00/- (fifteen lacs) and while lifting the office, they also took away C.C.T.V. camera in order to wipe out the evidence. During investigation, the name of the petitioner transpired. The petitioner has also confessed his involvement in the aforesaid incident and has given narration of story in what manner they have done it.

No.9294 of 2020(6) dt.04-01-2021 2/2 Learned counsel for the petitioner submits that save and except confessional statement, there is no incriminating material against the petitioner, no T.I.P. has been conducted and also placed reliance on the order passed in the case of Shivam Kumar @ K.K.C. in Cr. Misc. No. 75748 of 2019 on 07.01.2020 in which the plea was taken that the name of Shivam has transpired on account of confessional statement of the present petitioner but in this case, the petitioner has confessed his involvement in the incident, inasmuch as he has criminal history.

In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, the court below is directed to expedite the trial and conclude the same within one year from the date of production/receipt of a copy of this order.
