The petitioner seeks bail in connection with Korha P.S. Case No. 80 of 2014 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegedly, when the informant along with his employee, riding a motorcycle and carrying Rs. 20,00,000/-, was going, six un-known miscreants intercepted them, assaulted the informant and decamped with the aforesaid amount amounting to Rs. 20,00,000/-. During investigation the name of the petitioner transpired and he has been remanded in this case on 05.02.2015 and since then he is in custody but he has not been put on TIP. Submission is of false implication and that the petitioner is not named in the First Information Report, nothing has been recovered from his possession, he has not been put on
Patna High Court Cr.Misc. No.56052 of 2015 (3) dt.10-02-2016 2/2 TIP and similarly situated other co-accused namely, Md. Kaushar, Md. Monu, Chhotu Poddar, Md. Zafar, Md. Sheru and Karan Kumar Sonkhar have been allowed bail by different Benches of this Court and, as such, the petitioner also deserves sympathetic consideration.
The learned A.P.P. is not in a position to distinguish the case of the petitioner from those co-accused. In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Katihar, In connection with Korha P.S. Case No. 80 of 2014 corresponding to G.R. Case No. 14890 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
